| 摘 要： | 法律移植一词属于隐喻,在思维结构上,器官移植是喻体,法律移植是本体,基于它们之间的相似性,需要根据器官移植的语意,来理解、界定法律移植的含义.任何两个事物都可能存在着某种程度的共性,只有它们之间的类似性达到一定程度,隐喻的使用才是成功的.因而人们须对作为隐喻的法律移植一词保持着清醒的认识,明了其与器官移植的差异之处,防止张冠李戴式的误用.法律移植一词有着特定的历史背景,也意味着一种观察视角的选择,具有某种片面性,还需要其他的法律隐喻对其补充、校正或替代.

| Abstract: | Legal transplantation is a metaphor.In the structure of thought,organic transplantation is the vehicle,and legal transplantation is the noumenon.Based on their similarities and the contextual meaning,the connotation of legal transplantation can be defined.There might be similarity between any two things,but only when the similarity reaches a certain degree can the use of metaphor succeed.People should keep a clear mind of this metaphor and know the difference from organic transplantation to avoid misuse.Legal transplantation has certain historical background and means a choice of perspective,which is partial.It should be implemented,corrected and replaced by other legal metaphor. |
