国外环境渎职犯罪的立法现状及借鉴

综观当今国外关于环境渎职犯罪的立法，呈现日益重视对生态法益的保护、弱化对国家法益的维护等特点。而我国的环境渎职犯罪立法基于人类中心主义，关注维护人类利益胜于保护环境，实践中既无法有效惩治和预防环境渎职犯罪，又难以有效保护环境。文章指出应借鉴国外的立法经验，完善我国关于环境渎职犯罪的立法规定，并提出了借鉴的方向和具体的立法建议。

The Current Situation and Reference of the Overseas Environmental Crimes of Dereliction of Duty

An overview of today’s legislation on the overseas environmental crimes of dereliction of duty reveals such characteristics as growing emphasis on the ecological protection by law and the weakening of the maintenance of national interests by law .However ,China’s legislation on the environmental crimes of dereliction of duty is based on anthropocentrism and is more concerned a-bout preserving human interests than protecting the environment ,w hich makes it difficult to ef-fectively punish and prevent the environmental crimes of dereliction of duty and to effectively pro-tect the environment .This paper points out that we should use overseas legislative experience for reference to perfect the legislative institution of the environmental crimes of dereliction of duty in China and puts forward referential direction and specific legislative suggestions .
