突发公共卫生事件应急协同治理研究

突发公共卫生事件应急协同法治机制建设应适应后工业现代社会发展的客观需要。面对社会风险和治理难度都空前加大的突发公共卫生事件应急治理,应当采用突发公共卫生事件应急协同治理的制度模式,该制度模式将社会突发公共卫生事件的风险承担与治理逻辑内嵌于所有社会成员,通过构建领导中心与协商共治的多元主体结构,有序合理地将社会治理资源实现高效精准配置,同时将法治原则与实体权利、程序权利保障内涵于突发公共卫生事件应急协同共治体系结构中,实现对权力运行的有效规范和对权利实现的全方位保障。

Research on Emergency Coordination Management of Emergent Public Health Events

The construction of a coordinated legal mechanism for emergency response to public health emergencies meets the objective needs of the development of post-industrial modern society.In the face of the unprecedented increase in social risks and the difficulty of governance in the emergency management of public health emergencies,the institutional model of coordinated management of public health emergencies should be adopted,which embedded the risk-taking of public health emergencies and the governance logic in all members of the society.Through the construction of a leadership center and a multi-subject structure of consultation and co-governance,the orderly and reasonable allocation of social governance resources is efficient and accurate,and the principle of the rule of law,substantive rights,and procedural rights are connoted to emergency public health.In the event emergency coordination and co-governance system structure,the effective regulation of power operation and the all-round guarantee for the realization of rights are realized.
