平行进口与知识产权权利穷竭问题思考

平行进口问题在经济全球化的趋势下日益受到人们的广泛关注。支持或者反对平行进口涉及到知识产权的权利穷竭采取何种学说。世贸组织TRIPS协议将知识产权的权利穷竭问题留给各国自行处理。由于平行进口问题是相当复杂的一个问题,不同的知识产权领域有不同的权利穷竭原则。就注册商标商品的平行进口而言,不同的国家或地区有不同的权利穷竭原则。中国加入WTO后,平行进口与商标权权利穷竭问题将显现出来,我国商标法对此未作出规定,需要我们对此进行多方面的研究,以作出相应的规定。

A Consideration of the Problem Related to Parallel Importation and Intellectual Property Right Exhaustion

As the development in globalization of economy, the issue on paraelle importation is being wildly concerned over the world. To allow or ban parallel importation is related to the types of exhaustion doctrine (adopted) for intellectual property rights. The TRIPS agreement of WTO has left the exhaustion issue free to the members state to deal with. Different types of intellectual property rights have dissimilar exhaustion doctrine, (owing) to that parallel importation is rather a complicated matter. As for parallel importation of registered trademark commodities, exhaustion doctrine in each country or region varies. Parallel importation and trademark right exhaustion issue in China will become evident after China's entry into WTO. The trademark Law of PRC has no relevant provision. In order to make the relevant stipulation, a number of aspects should be studied to evaluate the pro and con of parallel importation.
