论《劳动合同法》中的劳务派遣制度

摘    要:《劳动合同法》关于劳务派遣制度的规定仍然存在一些不足。在劳务派遣单位的资格限制方面,缺乏配套的保障制度;在劳务派遣单位和用工单位的连带责任方面,规定得过于笼统;在派遣期限方面,缺乏明确的限制。应增加劳务派遣单位资格的配套性规定,合理划分派遣单位和用工单位在连带责任中的主次责任,明确劳务派遣的最长期限。

Abstract:There are some defects about the new provision of labor services dispatching system in the labor contract law: being lack of matched guarantee system in dispatching organization's qualification limit; the provision is ambiguous in respect of joint responsibility between dispatching organization and employer, and lacking definite limit in dispatching deadline. To consummate the system, the legislators should increase the supporting provision of dispatching organization's qualification, distribute the primary and secondary responsibility in joint responsibility between dispatching organization and employer rationally, and define the longest term of dispatching.
