| 摘 要： | 离婚损害赔偿立法在我国已有百余年历史,从其发端于<大清民律草案>到其被界定于<婚姻法>修正案,均以婚姻自由、男女平等、夫妻诚信、人格尊严、公平公正为伦理内涵.探寻离婚损害赔偿的立法流程和制度架构,有助于廓清我国现行离婚损害赔偿制度的疏漏,为离婚损害赔偿立法的科学化和完备化奠定基础.

| Abstract: | Legislation of divorce damage compenasation has hundreds ef history in China, which is based on marriage freedom, equality, honesty, personality dignity and justice. A study on the legislative procedure of divorce damage compensation and system structure will find out defects and establish a scientific and perfect system. |
