| 摘 要： | BOT涉及到许多部门法问题,其中涉及的建设权、经营权是一种新型的物权种类,政府保证是一种民事合同,除此外还涉及到其它的一些民事法律关系。本文试图从民法的角度去探讨BOT,以期望在BOT中正确适用民事法律制度。

| Abstract: | BOT deals with lots of department laws, but the mentioned right of construction and right of management are a kind of new titles. The government guarantee is a contract of civil law. Beside them, the relations of some other civi laws are involved. This article is about to probe into BOT from the civil laws, and this will play an important role in making use of the systems of civil laws correctly in BOT. |
