论建立我国的排污权交易法律制度

随着我国经济持续快速发展,人们对自然资源的开发利用速度越来越快.由于过量开发利用自然资源,过度向环境中排放污染物,使我国的环境质量恶化,导致了许多环境问题.环境保护日益被人们所重视,采用经济手段进行环境保护成为一种趋势,其中,排污权交易是市场经济下环境保护经济手段的重要组成部分.本文简要介绍排污权的概念,分析了中国的排污权交易政策和立法状况,进而阐述了排污权交易法律制度在中国构建的必要性,并提出构建建议.

On Establishment of the Chinese Emission Trade Legal System

With the sustainable and fast development of economy, the speed of exploiting natural resources becomes more and more fast. Due to exploring the natural resources excessively, discharging the polluting things to the environment unduly, it worsens the environment and results in a lot of environment problems. People pay more attentions to environment protection. It is a trend to take economic action to protect environment, among which emission trade is an important part of economic method for environment protection under the market economy. The article introduces the conception of emission trade briefly, analyzes the policy and legislation of emission trade in present China, discusses the necessary to establish an emission trade legal system in China, and makes some advices on how to establish this system as well.
