| 摘 要： | 代位权作为债的保全制度的一种,在新《合同法》颁布以后,在我国正式确立起来。它的确立为解决现实生活中的"三角债"问题提供了法律依据。本文从代位权的概念,特征以及代位权的行使等方面进行了阐述。
