| 摘 要： | 法律现实主义在美国法律思想史上的地位极其显著,然而,以往对法律现实主义的理解颇为狭隘。在主流的法律现实主义之外,还有一种激进的法律现实主义长期为人们所遗忘。通过对这种激进法律现实主义的考察和对法律现实主义兴衰的探索,可以揭示法律理论在社会中形成的机制,从而提示我们对于法律理论的认识和运用应该如何保持反思。

| Abstract: | Despite the distinct role of legal realism in the history of American legal thought,the understanding of it is still partial.Beyond the mainstream legal realism,there was another strand of radical legal realism.By focusing on the radical strand of legal realism and the rise and fall of legal realism,we can uncover the special forming process of legal theory,prompting ways of understanding and employing legal theory in a self-reflective way. |
