国际投资法自由化与我国外资立法对策

国际投资法已呈现出前所未有的自由化趋势,从而促使国际投资法律调整的结构框架和内容体系发生重要的变化,也促使各国利用外资及发展经济的政策和立法做出重要的变化.各国,尤其是发展中国家纷纷加快投资自由化的步伐,但盲目追逐只会对自身经济发展带来负面影响.因此,我国应正确对待国际投资法自由化的发展,并顺应这一形势的发展.本文从我国国民经济发展和国际竞争力提高战略角度,提出完善我国外资立法的一些对策.

Liberalization of International Investment Law and Legislative Countermeasure of Foreign Capital in China

International investment law has presented the unprecedented liberalization tendency,which makes the structural frame and content system of international investment law change significantly and also makes countries use the economy of foreign capital and legislation and policy for economy development and change considerably.Countries,especially developing countries are quickening the pace of investment freedom,but to pursue blindly can bring nothing but negative influence for self economic development.Therefore our country should treat correctly and adapt itself properly to the international trend.The paper,from the strategic angle of national economic development and international competitiveness improvement,puts forward some countermeasures of the consummation of legislation of foreign capital in our country.
