论社会制约权力

国家权力来源于社会,目的在于维护社会的公共利益。为了使国家权力不被少数人滥用,以社会制约国家权力十分必要。但在国家与社会一统化的阶级社会,阶级国家和国家权力被异化,社会屈从于政治国家而无法对其进行有效的制约。要实现社会制约国家权力,必须以社会力量的壮大以及政治国家和市民社会的分离为前提和基础。文章认为,发展市场经济,培育市民社会,转变政府职能,建立“有限政府”的国家—社会分权结构以及发展社会组织等,是实现社会制约国家权力的具体途径。

On Restricting State Power by Society

The state power stems from the society and aims to protect the public interest of the latter.In order that the state power might not be abused by a small proportion of the population,it is necessary to restrict the state power by the whole society.However,in a class society where the state and the society are united,with the latter succumbing to the former as a result of the over-extended state power,effective restrictions on the power are almost impossible.Therefore,the restraining of the state power by the society must be preceded by and based on the strengthening of the society and the separation of the political state from the civil society.This paper proposes some ways to achieve that goal,including the developing of the market economy,the establishing of a civil society,the transforming of government functions,the constructing of a framework for separation of the state-society power,marked by "limited government",and the support for NGOs.
