| 摘 要： | 我国刑法虽然规定了100多种单位犯罪,但在现实生活中,由于缺乏法律规定,单位危害社会行为得不到惩处的情况屡见不鲜,造成司法实践的困惑。我国单位犯罪应以现有规定为基础,从社会危害性和单位自身特征出发,确立单位犯罪的标准,对单位犯罪的范围进行适当调整。

| Abstract: | Although the criminal law in our country specifies more than 100 types of unit crime,in the realistic life,because of the lack of the law provision,many unit behaviors that endanger the society cannot be punished,resulting in the perplexity of the judicial fulfillment.This paper suggests that appropriate adjustments,based on the existing rules,should be made to the law of the unit crime.New standards of unit crime should be established,concerning the bad social effect caused by the improper unit behavior and the characteristics of a certain unit. |
