环境污染损害赔偿的相关问题探析

随着经济的飞速发展，环境污染的现象日益严重，“环境危机”已成为人类不可回避的问题，“环境污染侵害之民事责任”问题成为当今世界研究的一个主要课题。由于环境污染侵害的特殊性，决定了其归责原则不同于一般民事侵权的归责原则。分析了环境污染损害赔偿的构成要件以及归责原则等重要问题，以求对我国环境侵害赔偿制度有所裨益。

The question about the harm compensation for environmental pollution

Along with the rapid development economy, environmental pollution has become increasingly serious.“Envi-ronmental crisis” has become an unavoidable issue, the problem of“Civil Liability for pollution impair”, the issue has be-come a major topic in today＇s world. The specialty of pollution detecmines the principle of responsibility different from that of the general civil duties. In this paper, the author analyzed the environmental liability and damages the principle of the constituent elements, and the compensation system for environmental damage.
