| 摘 要： | 中国传统法律文化当中尽管在表达上没有明文宣示"权利",但是并不乏权利的思想观念,甚至在实践中也不乏保障"权利"的做法,比如对于生命权的尊重、对人身自由权的保护、对财产权的详细规定等。这些都是我们在现代制度建设当中可资利用的本土资源。

| Abstract: | Although our ancestor did not have the law term "right",there were notions of right in Chinese traditional law culture,and there were also method of guaranteeing "right" in practice.For instance,respecting the right to life,protecting to freedom of person,detailed regulations to ownership of property and so on.These all are precious resources could be made use of in modern legal system building. |
