| 摘 要： | 司法公正包括实体公正和程序公正两个方面内容。实体公正具有认识上的抽象性、模糊性和评判标准上的多元性的特点;程序公正具有可感知性和可操作性的特点。司法公正是司法活动赖以存在的基础,是司法活动的生命,是市场经济和民主政治的客观需要。司法独立是实现司法公正的根本途径,提高法官素质是实现司法公正的重要条件,完善监督机制是实现司法公正的保障。

| Abstract: | Judicial justice existsin substantive justice and procedural justice. It is difficult to realize substantive justice, because it is of abstraction and vagueness when understanding substantive justice and of plurality when commenting and judging. On the other hand, procedural justice has the characters such as perceptiveness and execution and it is easier to grasp, control and appraiseprocedural justice. Procedural justice is the foundation and life of judicial activity and the objective need of market economy and democratic politics. Judicial inde- pendence is the basic channel to realize judicial justice, a channel in which the improvement judges' quality is critical and and the perfection of its supervision system is the guarantee. |
