审判委员会制度存废的理性思考

审判委员会是我国特有的一种审判组织形式 ,它并不直接审判案件 ,只对经合议庭审理的重大或疑难案件进行讨论或作出决定 ,所以它是人民法院内部对审判工作进行集体领导的组织。近年来 ,随着人民法院审判改革的不断深化 ,合议庭及独任审判员的审判职权越来越大 ,司法界特别是人民法院内部要求废除审判委员会制度的呼声越来越高 ,他们认为审判委员会制度已不适应审判改革的需要 ,应废除审判委员会制度。现行的审判委员会中固然存在一定的弊端 ,但审判委员会的作用还是不可或缺的 ,只要对现行的审判委员会制度加以完善 ,审判委员会制度的存在是具有一定现实意义的。

The Think about the Judical Committee Member

Judicial committee is one of organization form of adjudication which was characterized by china ,it doesn't trial a case directly, but only discusses and draws a conclusion about those great and difficult cases that were adjudicated by collegiate benech .Therefore ,it is the organization inside people's court which charges the trial work collectively. In recent years, with the reform trial official power of collegiate bench and sole trial judge has becom more and more stronger and the voice of demanding to abolish the judicial committee institution has become more and more higher.they consider that the judicial committee insititution could not suit the trial reform and it should be abolished . It's no doubt that the current judicial committee institution has some malpractices,but the role of judicial committee is still necessary. so long as the current judicial committee insititution can be perfected, It still has some practical singnificences.
