| 摘 要： | 拍卖既有典型的买卖合同性质又有特殊性，而《拍卖法》对拍卖标的之瑕疵担保未作具体规定．本文就拍卖标的之瑕疵担保责任的前提、内容及免责事由展开讨论，提出个人观点，并对拍卖标的瑕疵的侵权责任作些粗浅的探讨。
