| 摘 要： | 从中国承担的国际义务看,中国应该从制度上限制死刑的适用。刑法已经在限制死刑的适用方面走 出了第一步。在刑法未能根本上消除死刑刑罚以前,刑事诉讼法也应该能够在这方面起到观念导向 和实际刑罚付诸实施的延缓作用。该文仅从管辖制度、证据制度、复核程序三方面对刑事诉讼法的上 述作用进行了探讨。

| Abstract: | To comply with internal standards, China should limit the application of death sentence. Strides have been made in this respect. Before death sentence is abolished, criminal law and procedural law should help to develop death sentence in this direction and to delay the use of death penalty. The paper explores the role of criminal law and procedural law in terms of jurisdiction, evidence and reviewing. |
