| 摘 要： | 现行的人身损害赔偿法律制度存在诸多的不统一和冲突之处,影响了司法公正,公民的合法权益难以得到保障。最高人民法院《关于审理人身损害赔偿案件适用法律若干问题的解释》完善了损害赔偿的裁判规则,更新了损害赔偿的理念,为《民法典》的制定奠定了基础。

| Abstract: | There are many conflicts in running human injury tort system,so it influences judicial fairness and the citizens' legal rights can not be protected properly. The judicial interpretation of human injury tort compensation system adopted by the People's Supreme Court makes the judicial doctrine of human injury tort compensation system more perfect, renews the idea of injury compensation and establishes a base for Civil Code or Civil tort law. |
