| 摘 要： | 根据出土文献、传世典籍中有关律令记载和司法实践 ,秦汉法律适用时效的具体表现有适用法律不溯及既往、适用法律不追究赦前犯罪、罪犯死亡后不追诉。这些适用时效的法律规定 ,既符合经济原则 ,有利于司法机关集中精力审理现行案件 ;又能防止少数犯罪分子逃避法律制裁 ,有效打击犯罪 ,在法制建设史上具有积极意义

| Abstract: | The applicable effectiveness for law of Qin and Han Dynasties concretely presented three: the suitable for use of law did not look into pastly crime; the suitable for use of law did not inquire into crime commited before amnesty order; the suitable for use of law did not prosecute the dead culprit and his family numbers and relatives. These regulations deeply possessed positive meaning at times in the past. |
