章太炎新法家思想的得与失

章太炎在尊荀的基础上赋予了“法”以下新内容:一是突出“法”的独立性,使其具有现代性；二是突出“习”对“法”的决定作用,区别荀子的“法”对“礼”的依附；三是强调“重生命”、“抑官伸民”等系中国现代法律的核心内容.这些均对当下中国现代法学建设具有重要启示意义.但是,如何处理法律在中国的独立与避免形成西方二元对立的关系,从而不破坏中国文化的整体性？“习为法本”是否还要深究“什么习俗为法本”的问题？“抑官伸民”重要还是“官与民”的内在结构改变更重要？这些问题的未决构成了章太炎新法家思想的内在局限.

Gain and Loss of New Legalist Thoughts of Zhang Tai-yan

Zhang Tai-yan endowed Law with the following contents.First,the independent nature of law is protruded,so modernity of law is got.Second,habit plays a decisive role in law,different from law’s adherence to ritual ceremony from Xunzi.Third,life is stressed and officials are restricted,which has modern significance.However,there still exist some problems to solve,such as how to deal with the independent nature of law in China and avoid that duality of the western countries,what kind of habit being as the root of law and so on,which have become the difficult points of Zhang Tai-yan’s legalist thoughts.
