| 摘 要： | 行政行为的无效是一个具有特定内涵的范畴,它存在的理论基础是行政行为公定力的有限性,并以公民的抵抗权为其价值背景,但其在实践中功效的发挥还需要实定法上制度化的努力方能得以落实。文章在界定行政行为无效的基础上,对建立我国行政行为无效制度提出了若干构想。
