| 摘 要： | 严格责任作为一种归责原则为英美法系所独有,大陆法系刑法理论一般不承认严格责任。本文从严格责任的概念入手,对严格责任的构成、严格责任与绝对责任的联系进行了分析和考察,认为我国刑法既无必要引入严格责任原则,实际上也没有规定适用严格责任的罪名。

| Abstract: | As a doctrine of liability fixation, strict liability has been characterized by Anglo-American law system. However, this doctrine has not accepted by continental Law System in general. Beginning with the concept of strict liability, this article analyzes and demonstrates its composition and the relationship between strict liability and absolute liability. Then, the authors maintain that there is no necessity to introduce the doctrine of strict liability into the criminal law of China, and there is no accusation that strict liability is applicable to in practice. |
