| 摘 要： | 解读和认定重婚罪,应当明确婚姻法的立法原则和价值取向。事实婚不受法律保护,法律婚是重婚的前提。只有法律婚才具有配偶权。法律婚与事实婚的重合,法律婚与法律婚的重合,都是对法律婚或者说配偶权的严重侵害,均可构成重婚罪。

| Abstract: | Unscramble and cognizance bigamy, should be definitude the lawmaking priciple and walue tropism of Marriage Law. Fact marry not be protected by law. Law marry is bigamous precondition. Only law marry just be provided with consort right. The superposition of neither fact marry and law marry severity aggrieve law marry or consort right. |
