| 摘 要： | WTO争端解决机制具有规则统一性、严格时效性、管辖自动性、突出司法性、强制执行性等特点，较好地解决了WTO成员的各种争端，并对WTO各协定作出了颇具创造性的解释。目前，中国面临汽车产业政策、税务减免等贸易补贴、知识产权保护和执法、对外国图书和音像产品的贸易权和销售服务等4个WTO争端，中国应积极应诉，维护中国的经济利益。

| Abstract: | WTO dispute settlement mechanism has new characteristics such as rules uniformity,time limitation,autonomous jurisdiction,prominent judicial act and enforcement,etc.It has resolved many disputes among the WTO members and made creative interpretation on the WTO agreement.Now,China is suffering four WTO disputes concerning the auto industry policy,the tax relief and other trade subsidies,the intellectual property rights protection and enforcement,and foreign books and audio-video products and trading rights and distribution services in China.The paper focused on the WTO dispute settlement system's formation,features,content,practice and gave some legal advises to China on how to use this mechanism to solve trade disputes and safeguard China's economic interests. |
