| 摘 要： | 结合WTO的有关案例 ,对争端解决机制中的举证责任问题进行了分析和研究。通过这些分析 ,明确了“确立初步案件”的概念 ,在不同案件中的举证责任如何确定问题上提出了作者的观点。最后 ,针对我国在争端解决程序中如何运用有关原则来维护合法的权益提出几点建议。

| Abstract: | Analyses theories and cases of the question of burden of proof in dispute settlement mechanism of WTO. Through the above analyses, specifies the concept of "presenting a prima facie case of violation before a panel", and puts forward the author's view about how to ascertain the burden of proof in different cases. In the end, presents some advice about how China can use the relevant principles and rules in the dispute settlement mechanism to protect our legitimate interests. |
