补充责任、相应的补充责任与责任人的追偿权

补充责任为二人以上共同承担责任中的一种责任形态,责任主体须为二人以上,且责任人在承担责任上有先后顺序之分。补充责任不同于按份责任,也不同于连带责任、不真正连带责任,属于共同责任中的一种独立形态。《侵权责任法》中规定的补充责任有两种情形,相应的补充责任为其中一种。相应的补充责任是对补充责任的一种限制,补充责任人承担的责任应与其过错相应,并以此为限度。补充责任人承担责任后可否追偿,应依责任发生的原因具体分析。凡补充责任人承担责任为对自己行为承担责任的,不应发生追偿。相应的补充责任人承担的相应的补充责任是对自己的过错行为承担的责任,因此相应的补充责任人承担责任后不享有追偿权。
