文化产业立法的国际借鉴及启示

文化产业是经济、技术与文化紧密结合的产物，为人类社会的财富创造和经济发展增添了新的增长动力，成为当代社会最重要的经济和文化现象。美国发展文化产业的版权保护制度，法国独具特色的文化多样性理念，韩国和日本的文化产业专门立法为我国发展文化产业提供了有益的经验。我国文化产业的立法路径应当选择确立基本法和具体法相结合的立法模式。加强与世界贸易组织文化贸易规则的接轨，构建文化产品内容审查制度、文化产业市场准入制度、文化产业市场管理制度和文化产业知识产权保护制度。
