论中国语境下宪法未列举权利的保护路径

宪法未列举权利的保护问题在我国理论界和实务界都没有受到应有的关注。参考域外司法保护模式的有益经验，结合中国的具体语境，我国宪法未列举权利的保护路径应为：依照宪法制定一部人权基本法，实现宪法权利向法律权利的转变，然后由最高人民法院在个案中通过对该部人权基本法中的“未列举权利条款”和相关条款的解释，实现对宪法未列举权利的间接保护。

The Protection Route to the Unlisted Rights in the Constitution in China

The protection of the unlisted rights in the Constitution has received undue attention both intheory and in practice in China. With reference to overseas experiences and in combination with Chinesecontext, this paper suggests to stipulate a basic human right law in line with the Constitution to ensure achange from the constitutional right to the legal right. The Supreme Court offers interpretations of relatedterms in the basic human right law through individual cases, which will protect indirectly the unlisted rightsin the Constitution.
