跨境游客权益保护的国际合作初探

各国在游客权益保护立法方面存在的差异，有可能成为跨境旅游业发展的瓶颈。目前，国际社会对跨境游客权益保护并未形成具有强制效力的国际性文件，但区域组织欧盟和南共市的经验值得借鉴。巴西向海牙国际私法会议提交的《保护跨境游客和访客合作公约草案》与世界旅游组织目前正在讨论的《游客消费者和旅游服务提供者保护公约草案》均表明建立以中央机关合作制为核心的国际合作机制是当前国际形势下，保护跨境游客、促进跨境旅游业可持续发展的有效途径。

International Cooperation in Protecting the Interests of Cross-Border Tourists

There are many differences between countries in protecting the interests of tourists, which would be the bottleneck of the development of cross-border tourism. At present, the international community has not reached a forced effective agreement on the protection of the rights of tourists, but there are some useful experiences made by regional organizations, such as the EU and MERCOSUR. ＂Draft Convention on Cooperation in Respect of the Protection of Tourists and Visitors Abroad＂ submitted by Brazil to HCCH and ＂Draft Convention on the Protection of Tourists and Tourism Service Providers＂ drafted by UNWTO indicate that the international cooperation mechanism based on the central authority cooperative system is an effective way to protect international tourists and to promote cross-border tourism in the current international situation.
