| 摘 要： | 在考察各国产品责任立法对产品概念的界定模式之后不难发现,我国《产品质量法》在产品概念界定中使用的加工、制作以及销售等字眼都不尽准确,有待于进一步科学界定.此外,应将电力及管道输送产品、血液与血液制品、初级农产品、智力产品、赠品等纳入产品的范畴,以更好地保护消费者的合法权益.

| Abstract: | After investigating the defining modes for the concept of product in product liability legislation of different countries,it can be found that the words-process,manufacture,sale and so on-in Chinese Product Quality Law are not rather accurate and need to be more scientifically defined.Besides,electricity products,pipeline products,blood and blood products,primary agricultural products,intelligence products,gifts,etc.should be included into the scope of product in order to protect the legitimate interests of consumers more effectively. |
