海南家庭暴力现状与防治初探

家庭暴力,是指发生在家庭成员之间的,以殴打、捆绑、禁闭、残害或者其他手段对家庭成员从身体、精神、性等方面进行伤害和摧残的行为.在家庭暴力案件的处理上,普遍存在干预难、取证难、认定难、处罚难等问题.海南的家庭暴力既具全国普遍存在的共性,也有自己的独特个性.针对海南家庭暴力的现状,可设置三道闸门加以防范:一为个人道德自律和家庭及亲友成员的内部调解;二为社会力量的介入;三为公权力介入的防治.三道闸门互相配合,环环相扣,真正地做到预防与治理相结合.

A Preliminary Study on the Current Situation and Prevention of Domestic Violence in Hainan

Domestic violence refers to the bodily,mentally,and/or sexually damaging behaviors by beating,trussing,immuring,mutilating or other ways among family members.Generally,it is difficult to intervene,collect evidence,and affirm when dealing with such cases.Domestic violence in Hainan presents national ubiquitous generality as well as local individuality.To prevent domestic violence in Hainan,three countermeasures should be applied,i.e.,reinforcement of individual self-discipline and interior intermediation among family members;intervention of community power;and intervention of public power.Only by coordinating and interlocking with each other,can they perform their preventing and governing functions.
