| 摘 要： | 依职权行政不作为是一种无特定行政相对方 ,侵害公共利益的违法行为。文章在对其内涵 ,特点及应承担法律责任等进行分析的基础上 ,指出可以通过公益诉讼制度来追究依职权行政不作为的法律责任 ,以体现现代法治的精神
