论侦查阶段律师帮助权

犯罪嫌疑人享有律师帮助权是享有诉讼主体地位的标志。我国现行刑事诉讼法规定犯罪嫌疑人在侦查阶段可以聘请律师为其提供法律帮助,在一定程度上改善了犯罪嫌疑人孤立无援的艰难境地。但从司法实践看,这种律师帮助权对犯罪嫌疑人所起的作用不大。与西方法治国家相比,我国律师帮助权的范围较窄,犯罪嫌疑人和律师的诉讼权利很有限。因此,我国有必要借鉴西方国家的成功经验,以完善犯罪嫌疑人的律师帮助权。

On the Right of the Help from Lawyer in the Stage of Investigation

The enjoyment of the right to counsel of the suspect is the mark of the status of subject.Chinese current criminal law states that the suspect can engage lawyer to provide help in the stage of investigation,which improves the isolation of the suspect in a certain degree but of little help to the suspect.Compared with Western countries,the right has a narrower scope and the suspect and lawyer have a limited right.therefore,it's necessary for our country to learn the successful experience of western countries to perfect the suspects' right to counsel in the stage of investigation.
