试论美国宪法中的"协定条款"及对我国的启示

美国宪法“协定条款”的成功给我国宪法相关内容的修改提供了很多有益的经验。实际上,我国宪法“行政协议条款”的缺失,在理论上引起了人们对地方政府缔约权的违宪性的怀疑,实践上导致区域合作的犹豫不决,甚至举步维艰,在这种情形下,该宪法条款的出台似乎势在必行。其立法模式是,宪法只是原则性地出台“协议条款”,其具体内容由《地方组织法》规范,并在其他法律或行政法规中以“实施细则”的形式进一步细化。

The Inspiration to China from Compact Clause in American Constitution

The success of compact clause in American constitution contributes to the amendment of our constitution.In fact,lack of "administrative agreement clause" in Chinese constitution leads to some problems,such as the doubt of the rights to conclude agreements.So issuing "administrative agreement clause" is necessary.The mode of legislation should be: issuing "administrative agreement clause" abstractly in the constitution,stipulating concrete content in the local organization law,and disclosing detailed rules in other laws.
