论物权变动与物权公示的分离

物权公示的对象是物权,而不是物权变动。物权公示只是在物权已经发生变动以后,将新的静态的物权归属状况表征出来,与物权变动是否发生效力没有关系。物权变动和物权公示不是一个层面的问题,两者所实现的制度目标、追求的制度价值、考量的相关因素是不一样的。物权变动和物权公示可以分离,并且应当分离,这一点在动产和不动产上都得到了明显的体现。而物权变动模式不过是在当事人没有作出特殊约定的情况下,为双方当事人之间的物权变动确定一个科学而又合理的时间基准。

On the Property Publication Separated from Property Alteration

The object of property publication isn't property alteration but property itself.Whether the property has been publicized or not cannot exert any direct influence on the validity of property alteration.The basic function of property publication is only to display the new static ownership of property after the property alteration has already occurred.They are different questions at different levels.There are lots of important differences between them in many aspects,such as the institutional goal,the institutional value,and the factors which should be considered throughly.So the property publication can be and should be separated from the property alteration.This kind of separation has been displayed obviously in both real property and personal property.Based on this,the problem characteristic of the selection of property alteration mode changes.The function of property alteration mode is to give a scientific and reasonable time criterion for property alteration between the parties concerned if they cannot reach a special agreement.
