| 摘 要： | 实证主义哲学对经验之外的形而上学命题进行了否定,这种认知范式在法学领域的运用就是分析实证主义法学的产生.与此同时,反实证主义者则从价值中立的不真实性、经验证实原则的无效性、反形而上学的不可能性以及归纳法的困境等方面对实证主义作出了批驳.需要判断的是,那些批驳在哲学中的真实度以及在法学中的有效性究竟如何.
