| 摘 要： | 从民事主体的角度分析,非法人团体有着不同于自然人和法人的特征,但它们的法律特征和现状完全符合确立民事主体的相关要件和标准,我国民法典应该打破传统的民事主体二元结构,赋予非法人团体民事权利能力,使其成为我国第三类民事主体。

| Abstract: | On the basis of an analysis of the civil subject,the unicorporated organizations have the characters differing from natural person and corporation.But their legal characters and actuality completely measure up the civil subject.Chinese civil law should break the traditional civil subject dualism and endow unicorporated organizations civil right qualification in order to let them become the third kind civil subject. |
