| 摘 要： | 党代表大会常任制是马克思主义执政党从根本上竭诚体现人民主权的组织形式,执政党通过这种政治运作机制,达到始终代表最广大人民利益的政治目标,因此党代表大会常任制具有人民主权的特征。同时,党代表大会常任制也是执政党在国家政治生活中有效控制国家政权的重要工具,它保证执政党政治目标的实现,因此又具有国家主权的特征。人民主权特征赋予其“政治领导”的政治合法性,国家主权特征则要求其能够有效分权制衡———这是国家主权宪政原则的必然要求。党代表大会常任制正是从政治合法性与分权制衡两个方面把人民主权与国家主权有机地统一起来。

| Abstract: | The permanent system of CPC's congress is characterized by both the popular sovereignty and the national sovereignty,and integrates them through the way of political legitimacy and checks and balances.It is not only the institution by which the Marxist ruling party can thoroughly embody the popular sovereignty with all her heart and carry out the ultimate political aim of representing the fundamental interests of the overwhelming majority of the Chinese people consistently,but also the instrument by which the Marxist ruling party can control the political power effectively.The Marxist ruling party can be granted the political legitimacy of her authority by the popular sovereignty and the inevitability of checks and balances by the national sovereignty according to the principles of constitutionalism. |
