| 摘 要： | 是否在WTO内谈判制定新的综合性的投资规则,争议颇多。主要争议在于分析欧盟、非政府组织和发展中国家的立场,依据若干客观标准总结在WTO体系内进行多边投资规则谈判的利与弊,其有利之处在于广泛的国际社会参与、弥补现行双边投资条约的不足、保持相互依存关系的平衡等,其弊端在于WTO的投资规则难于与现行区域投资协定保持一致,发展中国家政府能力较弱等。但总的说来利大于弊。

| Abstract: | Whether to draft new investment regulations through negotiations in the WTO remains a bone of contention.The paper examines the respective positions of the European Union,NGOs and the developing countries.Then it discusses the advantages and disadvantages in WTO's multi-party negotiations on investment regulations.Broader international participation,improvement of the current bi-party investment agreements and balance of interdependence are believed to be the advantages while the unconformity of WTO's investment regulations with the current regional investment accords is a disadvantage.The paper holds that the advantages outweigh the disadvantages. |
