On Electronic Checks in Perspective of Law

In case of withholding a forged check in the process of the operation of the electronic check, the bank can choose either the faker or the drawer to exercise its power. With an analysis of electronic checks with regard to writing, signature and evidence, this article shows that the electronic check has the same legal status as the traditional check. This article concludes that the legal status of the certification authority should be defined and its authority, duties and legal liabilities should be clarified.
