域名问题:权利的平等与平衡

尽管域名注册商标与目前存在的以企业名称作为商标注册的情况有很多共同之处 ,但是域名的商标法调整还面临着许多困难 ,如域名的弱显著性、可相似性、弱限制性等。这一困难使得我们在论证域名的法律地位时 ,必须将域名归入知识产权保护的客体范畴 (知识产品 )才能得出正确结论。这必然要求我们考虑确定域名权范围两个主要因素 :一是域名的技术特征给域名权的范围所带来的必要的限制 ,二是贯穿于知识产权制度始终的利益平衡机制

The Problems Related with Domain Name: the Equity and Balance of the Domain Name Right

After discussing the difficulties of the domain name protection ensured by the trademark law, and clearing for the legal research methods applied to the authorization of the legal position of the domain name, the thesis expounded that the domain name should be protected by the intellectual property law as a new and independent object, and also be treated equally as the trade mark protection. In view of the technological features of the domain name and the balance of interests, the scope of the domain name right differs distinctively from the trademark right, while the former expresses itself in which the exclusive right of domain name does not exclude the use of the similar domain name, the latter does in area of the trademark law.
