道德法律化:一个虚假而危险的命题

针对我国社会转型期道德水平整体滑坡的现状 ,有学者提出了“道德法律化”的应对策略。这种主张混淆了道德与法律的本质区别 ,在逻辑前提上存在着无法弥补的漏洞。从事实层面上看 ,“道德法律化”是一个虚假命题 ,是对“法的法律化”的误解 ;从价值层面上看 ,这一命题隐含着道德标准绝对化和道德约束强权化的倾向 ,对社会道德生活存在着巨大的潜在威胁

Moral Legalization:A Fictitious and Perilous Proposition

In view of the present situati on o f holistic declination in morality during the period of societal variation in Ch ina,some scholars suggest the corresponding strategies of moral legalization.The advocacy has confused the essential distinction between morality and laws, whic h ,in the logical prerequisite, exists unremedied loopholes.From the realistic p erspective,on the one hand ,moral legalization belongs to a fictitious propositi on, which is virtually misunderstanding of legalization of jus, on the other han d, in value it implies such tendencies as absolutization of moral standards and powerization of moral restraints, which is a severe potential threat to our soci etal moral life.
