| 摘 要： | 一个运行良好的量刑机制的建立,不仅需要有完善的静态构造,而且更需要诸构成要素间的良好配合和联系。当前我国的量刑机制尚处在静态结构的建立和完善阶段,只有对量刑原则、量刑实体规则、量刑判例指导制度等静态结构进行修正和弥补,才能建立动态的良好且高效的运行机制。

| Abstract: | Sentencing mechanisms include not only the dynamic operation of the process, but also the static organizational structure.A well-established sentencing mechanism needs not only aperfect static structure, but also the good cooperation between various elements.China’s current sentencing system is still in the stage of establishment and improvement of the static structure.In order to create an efficient operation mechanism, we should amend the static structure, such as sentencing principles, sentencing substantive rules, the guidance system of sentencing jurisprudence,e tc. |
