| 摘 要： | 探讨了ＢＯＴ特许协议的定位、东道国作为ＢＯＴ主体的身份确认等法律问题。作者认为ＢＯＴ特许协议属于国内契约，指出ＢＯＴ特许协议的东道国主体只能是中央政府。
