| 摘 要： | 学术权力是学术人员对学术事务的一种影响力和支配力,是高等院校中特有的一种公权力,法治理念和学术权力的运行现状需要法律对其加以规制,规制的内容包括:制定相关学术法规,规定学术权力行使的条件、原则和遵循正当程序原则,构建包括申诉、学术仲裁、诉讼等在内的学术权力纠纷解决机制。

| Abstract: | Academic power refers to the influential and dominating power of the academic personnel upon academic affairs and a special public right in the high educational institutions.In view of the idea of governance by law and the current situation of academic power in motion,it is necessary to make legal regulations in the following aspects: making relevant academic regulations,specifying the conditions and principles for the implementation of academic powers as well as the guidelines for correct procedures,and to work out a mechanism for the solution of entangling problems as concern the academic powers in the appeal,arbitration and lawsuit. |
