论法治的灵魂

人类个体对自由解放和满足的不懈追求是人类社会不断进步的动力和原因。人类的文明进程又在不断地促进这些自由解放和满足。无论过去和现在,人的世界和人的关系都呈现出不同程度的异化状态。要把人的世界和人的关系还给人自己,就要从根本上消除这种异化状态。以公有制取代私有制也许是最好的选择,但那需要相当长的历史时期。如果我们在不放弃这种追求的同时能通过现代法治争取一些立竿见影的效果又何乐而不为呢?所以从人类文明进程来说,尊重和保障人权是法治的最高价值和灵魂。

ON THE SOUL THE RULE OF LAW

Human being's constant pursuit of freedom liberation and content is the move and cause of the progress of the human society. The progress of human civilization gradually develops the freedom liberation and content. No matter whether it is in the past or at present, the world and relationship of human being present a state of alienation. If a man wants to get the world and relationship of human being returned, the state of alienation must be diminished. The substitution of public ownership for private ownership may be the best choice. But it requires a long period of time. It would be a happy thing if we can achieve instant results by means of rule by modern law without giving up the pursuit. Therefore, from the progress of human civilization, the respect and guarantee of human rights is the highest value and soul of the rule of law.
