| 摘 要： | 成文法是法律发展到高级阶段的形式,具有稳定性和体系性等优点,但“有阳光的地方就有阴影”,成文法也存在一些自身难以克服的局限性,例如模糊性、滞后性和僵化性等。为了克服成文法的上述局限,我们必须引入西方的判例制度和法官合法行使自由裁量权的传统来加以克服,更好地实现法律对社会治理的作用。

| Abstract: | Statutory law is the foremost form of law, and it has some definite, stable and systematic virtues. But we all know that so long as there is sunshine there is darkness. Therefore, statutory law also has some problems that it cannot overcome by itself, such as ambiguity, out of date and rigidity. To solve these problems, we should borrow the system of "stare decisis" and system of right of discretion, and only in this way can we realize law' s function of social control. |
