| 摘 要： | 授权立法是现代国家法治的需要。我国《宪法》第100条和116条是我国授权立法的法律依据。本文试图以行政立法和地方立法作为切入点，对授权立法的利与弊、得与失作一个客观的剖析。

| Abstract: | Empowered legislation is necessary,when a modem country seeks the rule by law The looth item adn the 116th one in ournational constitution are the basis for empowered legislation Neverthless,its advantages and disadvantages appear at the same time,just like twin brothers,when we inquire into the newly emerging thing in a dialectical way The author intends to make an objectiveanalysis of the advantages and disadvantages related to empowered legislation by commencing to analyze the administrative legislationand local legislation as the point of tangeney. |
